Q about fees for PPT shipped to FFL

    Q about fees for PPT shipped to FFL

    If I buy a rifle from a remote seller and have it shipped to my FFL, are they limited to the $35 PPT fee or can they add a handling fee, and if so, is there a limit on the handling fee?

    I see something in the classifieds I'm potentially interested in, but I want to make sure I understand any hidden costs.

    if it is shipped to the FFL, it isn't a CADOJ-defined PPT. As such, there are no limits to the transfer fee that the FFL can charge. The only thing they can't do is claim that the state DROS fees are more than $25. everything over the $25 must be stated as a dealer feee.

        Are FFLs required to collect sales tax on shipped private party transfers?

                And they still tax used guns. At least they did on my Colt and Beretta.

                This state just can't get enough taxes...

                  I am currently transferring a rifle from someone in Southern CA. My FFL said CA requires sales tax on any firearm that is shipped for a transfer, including used ones from out of state, and in sate transfers. The only thing still exempt is FTF PPT I guess.

                    Yes, this is correct. Some FFLs will not charge tax on used firearms, but if push came to shove the FTB would bill them for the tax...they are responsible for paying it just as any merchant is. So some just hope for the best, while others plan to be examined and just pay the tax as a way to appease the auditor.

                          I'd rather pay him the tax than have him lose his license. He's made all my transfers for stuff I can't get locally extremely easy.

                            The last transfer I did, two weeks ago, the local FFL did not charge tax because, he said, it was from a private individual. He's under the impression that he only charges tax if the seller is an FFL retailer.
                            Someone is muddled up. Are there any statutes that would clear this up.

                              This is correct, and everybody else is wrong.

                              FFL's are supposed to collect tax ONLY on firearms sold by a retailer (dealer), in or out of state.

                              FFL's aren't supposed to collect tax on a firearm sold to the buyer by a private person aka not a retailer.

                              So if you buy a firearm on gunbroker.com from a private person who is simply selling one of their personal firearms and they are not a dealer or do not have a business selling firearms, then no tax.

                              Whether the firearm is new or used makes no difference - only who is selling it.

                              However, that doesn't mean that FFL's may not correctly understand when to collect tax, and may try to collect tax on all firearms shipped to them regardless of who they came from.
