    New to CalGuns / New to CA Handgun Laws

    Trying to understand elements of private party sale and have conflicting inputs. I know an FFL is needed for private party transfers of handguns and both buyer and seller need to be at same FFL location simultaneously filing out forms. Seller gives gun to FFL and there is the ten day background check period. Here are my questions:

    1. When does buyer pay for gun and to whom (to FFL for safe third party handling or to buyer)? If gun comes up flagged and can't be sold it gets turned over to authorities. If you paid buyer good luck getting money back.

    2. Can you check serial number with DOJ to determine if its registered to seller and available to sell?

    3. When you are buying a used gun that's on roster it's not considered a private party sale and FFL can charge greater than $10 to make transfer??? Is this correct?

    4. Buying off roster handguns from LEO are there any other limitations, like not being able to get high capacity magazines, etc?

    Would appreciate any assistance forum can provide.

    Pretty rare for stolen guns to be sold through an FFL (required here), since the seller has to show ID.
    Generally, the buyer pays the seller when they meet up to transfer the gun.
    FFLs rarely broker the money, although some small businesses might.

    2.

    No, used gun or NIB from a "private" seller is still a PPT.
    $25 + $10 to PPT in most cases. More is not allowed.
    (Dealer can charge what they want for shipped transfers such as on roster handguns from out of state.)

    4.
    No high capacity (over 10 rd) mags. (aka standard mags.) unless you are the right kind of LEO yourself.

    I assume you have an FSC, if not you will need one.

    Also, is your address on your CA drivers license accurate?
    Same for car registration or utility bill that you will use for the second ID.

      What does NIB mean? Yes I have the California firearms safety course ..... took it in 2014.Thanks for update.

        NIB = New In Box.

        And all firearms need to go through FFL here, not just handguns, unless it is direct family and both parties live in CA.

        1. Buyer pays the seller directly, as soon as buyer inspection of the firearm is complete and usually before any paperwork is completed.

        3. All private party transfers are $10 per gun + DROS fee. It does not matter new or used, on roster or off roster, handgun or longgun.

        However if you buy a used or new on roster gun, roster exempt gun, or any long gun and have it SHIPPED to the FFL, that is not a PPT, and the FFL can charge any fee.
