(c) Prior to issuing a REAL ID identification card,
(1) A State must check with all other States to determine if the applicant currently holds a REAL ID driver's license or identification card in another State.
(2) If the State receives confirmation that the individual holds a REAL ID card in another State the receiving State must take measures to confirm that the person has terminated or is terminating the REAL ID driver's license or identification card issued by the prior State pursuant to State law, regulation or procedure.
The verbiage is ambiguous because the US passport book/card is a form of REAL ID:

The U.S. passport book and the U.S. passport card are REAL ID compliant and are acceptable identification to board domestic flights.

AFAIK...

It's in reference to State issued REAL DL/ID cards.
^Can only have one valid State issued REAL ID.

US Passport and Passport Card is issued by the Federal Gov, not by a State Gov.
So, it's not included in the restriction.

Is it a fair reading? The word card is defined in the regulation as being issued by the State DMV. Passports are not issued by a State and certainly not by a DMV..

6 CFR 37.3 provides, in part, that:

? Why do you ask 'is it a fair reading' and then post information that suggests it is, indeed, a fair reading?

In my experience, a 'fair reading' is one that seems consistent with known information and usage.

Just a re-assurance - the Federal and California laws discussed in this thread, beginning in 2012, HAVE NOT CHANGED - this thread is current as of July 15, 2019, and likely to remain so.
