Infuriating how they are trying to pull procedural maneuvers to keep this thing alive. I'm going to call my rep again (he was a NVR last week, need to make sure it stays that way).

Short Update:
Floor Session was postponed yet again. Next session will be Monday, June 14 @ 3PM.

Rules Committee met 15 minutes before when the session was supposed to take place. They voted on adding an urgency clause to AB-1223. Jordan Cunningham (District 35, Republican), Vice Chair of the Committee said of AB-1223:

Without speaking to the merits of the bill, I'd just note for the record that this bill died on the floor before the house of origin deadline, and I believe it's improper precedent for the rules committee to add an urgency clause to revive a bill that died on the floor and did not pass by the deadline.
It then went up to a vote, and passed along party lines; 9 Ayes to 3 Noes.

As such:

Joint Rule 61 has apparently been suspended for AB-1223, allowing for it be voted via reconsideration on the Assembly Floor after the bill deadline.
Please call/write your Assembly Members to vote No on AB-1223 during the next floor session.
If you need help doing that, there's a thread on Reddit giving a walkthrough on doing that, as well as talking points, as featured in Reno May's video on AB-1223.

Your/Our representatives regularly, "suspend the rules".

You do realize the rules they are suspending IS the California Constitution.

If it's so easy to suspend the rules then NO RULE is worth the paper or screen dot it is written on.

Apparently I was wrong on this. They had a speedy session yesterday and I just happened to miss it. Video of the session wasn't available or wasn't available immediately afterward (I checked it at 9:43AM) and wasn't loaded until way later.

Bill has been amended to add the urgency clause. Perhaps Joint Rule 61 hasn't been suspended, but adding that so it could be amended was what the Rules Committee did; I'd have to look up the rules.

Votes were 50 for the amendment (They only needed simple majority to pass the amendments), instead of the 46 for the bill last time it failed. On Monday they'll need 54 votes to pass the bill into the Senate.

It’s been a long time, and my memory fogs on some of these maneuvers, but I think the Rules allowed Levin to submit the purported urgency to the Rules Committee. The Committee approved the urgency amendment, and that Urgency Clause removed the requirement for clearing First House by deadline. It then went from Rules Committee to the Floor and the Amendment passed, sending it to print and back on File. Three day print rule should make it viable for Monday’s File and later during this Session.

The recent Benitez ruling on AWs is fueling a desire to respond and giving dead issues “legs”.

Urgency my a**. Their only urgent desire is to put a lid on the surge of gun sales by taxing the crap out of them "because gunz."

What I find the most interesting about the urgency clause, which puts the law into effect IMMEDIATELY, is that the bill doesn't do anything except collect taxes and put them in an account. In other words, there's an URGENCY TO COLLECT TAXES. It's pretty ridiculous.

California
West Virginia recently decided to have zero sales tax on guns/ammo. The rational was a Constitutionally protected right shouldn’t be taxed.

Since Summer recess begins July 16, not acting on it by then would seem to not support the “Urgency” of the Legislation. But, this group has already shown they don’t give a crap. Sen Skinner claimed that the Budget sent to Newsom was a two-party agreement. However, the D’s will get Budget agreement from Newsom, and then they will occupy Jun/Jul with Budget Trailer Bills to appropriate funds for the Budget provisions. I suspect they will try to tuck this little gem into a Trailer Bill and simply slip it through.

Once again the bill was not voted on; basically the Speaker just looked at AB-1223 and another item on the agenda and did Pass and Retain (assuming I heard it correctly), so who knows when this bill will be voted on. Next floor session is on June 21st @ 1PM. I'm not going to bother trying to follow this bill anymore until and if there's a vote on it, since as other posters have noted below this thing could be voted on at any time.

Thanks everybody who has been calling your Assembly Members; If you haven't done so please do so but it could be a while until we actually see this bill do something.

Edit: So here's' the thing. It was put on Pass and Retain, which requires unanimous consent. So that means even the Republican members are giving unanimous consent for this bill to keep floating out there, right? If even one refused to Pass and Retain, the bill would at best be put on Pass on File, and then if it wasn't voted on then, it'd be put on Inactive File... which would then require the author to put it back on active file (with 1 day advance notice) if/when they wanted to vote on their bill, right?

After 6 decades here, I know full well how we are being taxed in this state, but it has nothing to do with events in 1776. Then, the taxes were levied locally and removed to Britain. Now, the taxes are levied in CA and redistributed within CA. There’s a difference…it’s called socialism.

This might lead (future tense) to revolution in the future, but that will take place when the progressives are unable to provide free everything to the masses who will invade us in the next decade.

There will be no future revolutionary war waged here over taxes. It will be fueled by the masses rising against the unfulfilled promises of the progs.

I don't think this will go anyplace in the end.. There having such a hard time with the assembly and it still has to go to the Senate.

Uh no deflection on my part it was a direct response to the excessive taxes in California nothing more nothing less. You took a simple statement ran off with it on your rant in this post quoted.

At no point did I refer to the Revolutionary War and really no need in an adhoc history lesson about it.

But continue to think it was deflection as my response was only to one person not you.

I'll make it real simple for even a cave man can follow it.

When it's a close vote it can most definitely matter. This was a close vote as has been previously discussed, as it originally failed on the floor on the third reading because 12 Democrats chose not to vote.

To be even more clear: It's not often that a gun control bill fails on a floor vote in the CA legislature. Usually if a gun control bill is just popular enough but "problematic", it has to do with money, in which case it's held up on the consent calendar and left to die. If it's not held up there, then the leadership holds the bill up somewhere else. It is extremely rare for a gun control bill to make it to a floor vote and then fail; especially in the house of origin... where the CA democratic party holds a supermajority in all 3 branches.

The fact that a gun control bill failed on the floor of the assembly is an embarrassment to the author and also partially to the party that holds a supermajority.

Yeah they didn't. I didn't watch the video but it just keeps getting held over and left on the Daily File every week.

I'm not sure why there isn't a single Republican opposing the Pass and Retain motion. It takes unanimous consent. If one member does not consent, then it goes to Pass On File (same link as above). Then if they don't vote on it, it goes to the Inactive File (same link as above).

Now ultimately none of those kills the bill, but the main advantage of being on the Inactive File is that if it's taken off the inactive file then one day public notice must be given. That means that we'd actually have notice if it were actually coming up to a vote (I'd have to look up where they give this notice though).

I think from an argumentation standpoint it looks even worse for the author that their "EMERGENCY BILL" went dormant because they author decided to wait to pass the emergency.
