Default Dros Delay Question

Hey guys i bought a gun on feb 1st and got called on the 7th with a delay. So a month later im still waiting and no word. now i kinda need some money.
Anyways my question is since i paid for the gun and own it can i sell it? Even though i never picked it up or or cleared dros?

From what I understand you can just cancel the transaction and walk away. Your FFL may charge a restocking fee for it though.

that sucks can i do a consignment or anything? i got the gun cheap and i have a chance to make money on it. i was arrested four years ago, but had no charges filed. no courtdate, nothing.

You don't really own the firearm, you just paid for it. The paperwork is the process of changing the ownership.

Assuming your FFL agrees, you can sell the firearm, but the FFL has to make sure that it is not a straw sale, so selling it out of the area would be better. It could be assumed that anyone local is buying it for you and the FFL should not take a chance with that.

Did you have it shipped in or did you buy it from the FFL doing the transfer? If you bought it from the FFL doing the transfer, the FFL might not want you to sell it and make money, but they could refund your money.

i bought it at the ffl where it still sits. i was just thinking of listing it on here or gunbroker, not someone i know. i dont want anyone to get in trouble. there should be no reason for me to get denied, i just could use some money now, ive been reading stories of people on 60,90 110+ day delays. im on 31 myself.

You would need to ask the FFL to see what they are willing to do. They might want to charge a re-stocking fee and refund you money, or perhaps just give your money back. They might be ok with your selling it on an auction or perhaps not.
