Default 2016 California Bills Index thread

This is the second year of the 2015-2016 Legislative session.

This thread is to help members find the existing threads about bills submitted to the Legislature. The reason this is needed is that the bills are all submitted in December, January and February, threads get started, then the bills and threads just sit until May or June - falling off the first few pages her due to lack of activity.

Here we are in December 2015, and the second half of the CA Legislature's 2015-2016 session is nearly upon us.

Feel free to add a post announcing a new bill, as you encounter one.

Links to the actual bills are very helpful. Please do not title threads 'Oh, they're being stupid again' or other expression of outrage - title it more like 'AB 12345 El Diablo Ammunition (2014)' -- the bill number, the author, the subject and the year all help us keep track.

Honest, folks, one thread per bill is plenty.

And, it's my personal opinion that all the anguish that get posted is rewarding to the people who write and submit the bills.

Remember -
  • passing out of a committee does not mean 'the law passed';
  • passing from one house to another does not mean 'the law passed';
  • passing through both houses and going to the Governor DOES mean the bill passed;
  • ONLY WHEN the Governor vetoes a bill do we know a bill that gets to him is maybe dead, because a veto may be over-ridden -- the Big Date is September 30.

Here are the significant dates, from the Legislative Calendar:

Jan. 4 Legislature reconvenes (J.R. 51(a)(4)).
Jan. 10 Budget Bill must be submitted by Governor (Art. IV, Sec. 12(a)).
Jan. 15 Last day for policy committees to hear and report to fiscal committees fiscal bills introduced in their house in the odd-numbered year. (J.R. 61(b)(1))
Jan. 31 Last day for each house to pass bills introduced in that house in the odd- numbered year (J.R. 61(b)(3)), (Art. IV, Sec. 10(c)).

Feb. 19 Last day for bills to be introduced (J.R. 61(b)(4), J.R. 54(a)).

May 31-June 3 Floor Session only. No committee may meet for any purpose except Rules Committee, bills referred pursuant to Assembly Rule 77.2, and Conference Committees (J.R. 61(b)(10), J.R. 61(h)).


June 3 Last day for each house to pass bills introduced in that house
June 6 Committee meetings may resume (J.R. 61(b)(12)).
June 15 Budget Bill must be passed by midnight (Art. IV, Sec. 12(c)(3)).
June 30 Last day for a legislative measure to qualify for the Nov. 8 General Election ballot (Elections Code Section 9040).

Aug. 31 Last day for each house to pass bills, except bills that take effect immediately or bills in Extraordinary Session (Art. IV, Sec. 10(c), J.R. 61(b)(17)). Final Recess begins upon adjournment (J.R. 51(b)(3)).

Sept. 30 Last day for Governor to sign or veto bills passed by the Legislature before Sept. 1 and in the Governor's possession on or after Sept. 1 (Art. IV, Sec.10(b)(2)).

So, when do these go into effect?

If a bill passes, goes to the Governor, and either he signs it or allows it to become law, the default effective date is in Article 4, Section 8 of the California Constitution:

subdivision, a statute enacted at a regular session shall go into
effect on January 1 next following a 90-day period from the date of
enactment of the statute
Each bill may have its own different effective date, even different dates for different parts, if specified in the bill that becomes law.

Here are the deadlines for the next few months:

2/19 is the deadline to introduce a bill.

4/22 is the last day for policy committees to hear and report fiscal bills back to the floor.

5/6 is the last day for policy committees to hear and report non-fiscal bills back to the floor.

5/13 - last day for policy committees to meet until 6/6

5/27 - last day for fiscal committees to hear and report bills introduced in their house - last day to meet until 6/6

6/3 - last day for bills to move from house of origination to the other house

SB 1235, De Leon, 2016, redefines ammunition. Removed reference to ammo being specifically designed for handguns.

UPDATE: Bill amended 4/25/2016: Bill now requires universal ammo registration and background checks. Outlaws F2F purchases. Requires vendors obtain a state permit.

What I dislike about this thread is that it doesn't show where each bill stands, just provides a link to 7 pages of pointless arguing, hand-wringing, and "time to leave CA" statements.

I want to know where each bill stands.

Every single bill for gun control was just voted on and pass to the floor for an upcoming vote. This is absolute railroading at it's finest. It was on a live web stream. Please focus your attention on your reps.

Do we have a current list that isn't a few posts long? I just want to see what is still on the table and I know 1663 is off but it's still listed up top.

This is an index of existing threads regarding this years legislation.

This is not an up-to-date thing.

In fact, there isn't even threads on every single piece of firearms related legislation here. There are a few minor ones nobody ever discussed.

Below is a complete list of the bills passed today [6/30]:

AB 1664 (Levine & Ting): AB 1664 would extend the definition of an assault weapon to include all semi-automatic rifles and pistols with a removable magazine and that use “bullet button”. For example, an AR-15 would be included in this.

AB 1673 (Gipson): AB 1673 would take the definition of a firearm and extend to it include any unfinished frames or receivers that can be converted into a weapon. This bill could make any object that is associated with a firearm subject to the same regulations that apply to firearms.

AB 1674 (Santiago): AB 1674 would add to the current restrictions that are placed on an individual in regards to how many firearms they can purchase in a 30 day period. Current law states that only one handgun can be purchased in this time period but if this legislation is passed, long guns would fall under this restriction as well.

AB 1695 (Bonta): AB 1695 would require the Attorney General to send individuals a pamphlet regarding all firearm laws, how to safely store your weapon, and gun trafficking. This measure would result in wasteful government spending as criminals will not be receiving these pamphlets, only law-abiding gun owners who are already aware of this information.

AB 2607 (Ting): AB 2607 would allow an employer, coworker or mental health worker to file a restraining order on an individual to keep them from owning a gun. This individual would not be allowed to defend themselves until 21 days later. In this time, they would have their right to bear arms stripped from them, regardless if the claims were true or not..

SB 1235 (De León): SB 1235 requires background checks for ammunition purchasers, licenses to sell ammunition, and collection of sale information. Restrictions on ammunition purchases, creates a DOJ database of ammunition owners. Bans internet / out of state ammunition purchase.

SB 880 (Hall, Glazer): SB 880 redefines assault weapons to encompass specified guns capable of accepting any type of detachable magazine. Bans common and constitutionally protected firearms that have magazine locking devices.

SB 1446 (Hancock): SB 1446 prohibits the possession of magazines that hold more than 10 rounds. Confiscation of lawfully acquired, standard capacity magazines that can hold over 10 rounds.

SB 894 (Jackson): SB 894 requires the reporting of a lost or stolen gun within 5 days of when a person knows or reasonably should have known of the theft or loss. Victimizes victims by criminalizing the failure to report lost and stolen firearms.

We urge you to contact the Governor and let him know that you will not stand for any of the anti-firearm bills passed in the legislature today and urge him to veto all of them. To contact his office you can call:

Bills Brown signed:

▪ Assembly Bill 1511, by Assemblyman Miguel Santiago, D-Los Angeles, requiring that the infrequent loans of a firearm be made only to family members.

▪ Senate Bill 880, co-authored by Sens. Isadore Hall, D-Compton, and Steve Glazer, D-Orinda, and Assembly Bill 1135, Assemblyman Mark Levine, D-Greenbrae, amending the definition of assault weapon to include semi-automatic rifles with magazines that can be detached with a button.

▪ Assembly Bill 1695, by Assemblyman Rob Bonta, D-Alameda, mandating swifter reporting periods for lost or stolen firearms.

▪ Senate Bill 1235, de León, creating new regulatory framework for purchasing and selling ammunition.

▪ Senate Bill 1446, Sen. Loni Hancock, D-Berkeley, banning possession of high-capacity magazines holding more than 10 rounds.

Update 09/01: The legislative session is over. There are still items requiring action by the governor.

I tried tracking bills through the year, it is very difficult but since things are more set in stone I can say with better certainty what's what.

I've compiled and sorted some data and will show that here. Sources for this info include our very own calguns.net, calnra.com, crpa.org/2016-bill-status-update/ and the legislatures own site leginfo.legislature.ca.gov/faces/home.xhtml

1) Bills introduced/amended with some relationship to firearms in 2016.
2) Same list, showing only bills that failed to be "enrolled."
3) Narrowed to show bills that WERE enrolled.
4) Bills enrolled but requiring action from the governor (sign, veto, no signature = becomes law)

Terms:

Enrolled = Passed by the legislature (still requires action by the governor to become law)
Chaptered = Enrolled and signed (in most cases) by the governor

Note @ 4), I haven't fully vetted the support/oppose recommendation on each bill there but I'm fairly confident in my assumptions. I will verify tomorrow and change if needed.
