Default Moving Back to California with an AR pistol

Hey Guys,

I am very confused on CA law, I know we can bring off roster handguns back into CA, does that apply to ar pistols as well?

Just make sure that your AR pistol is in a legal configuration and that California cannot consider you as returning resident.

That's an important point because if you are a returning resident, and you are bringing in a handgun purchased after 2015, then you're committing a felony. Please refer to PC 27585 and 27590.

So what your saying is if I moved to Texas, established Texas residence for 5 years plus purchased new pistols- CA off roster, I would not be able to transfer new pistols is I decided to return to California ?

If you maintained your CA residency, while you lived in TX, CA would still consider you a CA resident even though you were residing in TX.

Examples of maintaining your CA residency... having a valid CA DL/ID, owning property in CA, being registered to vote in CA, having vehicles registered in CA.

As a CA resident, it is not legally to import firearms that you acquired, while outside of CA, without the use of a CA FFL dealer. [PC 27585(a)]
^Handguns imported into CA need to be listed on the Roster of Handguns Certified for Sale or be exempt from it (C&R, OTP, SAE, SSE2).
~Failure to utilize a CA FFL dealer equates to a misdemeanor per long gun [P 27590(a)] and a felony per handgun [PC 27590(c)(7)].

Take it apart in TX and use the receiver to assemble a featureless receiver with an cheap A2 stock/fin grip.

Sell the pistol upper in Cali. and get more $ for it here. Use the $ to buy a new upper with muzzle brake. Use the Californicated AR here.

Don't like the result?
Sell it in Cali. as pre-Californicated and save the money for taxes. You'll need it.

Gas price in Texas is $2.20 vs California $3.90. Hmmmm...

If I can liquidate everything now, I’d pack up and find a place in Texas. Only thing stopping me is my kids will hate me for it.

Maglock it, don’t turn it into a rifle. Under California law you cannot go back and forth from pistol to rifle to pistol. Pistol uppers are not roster items, everyone can order them online, so you would not get more than free market price for a pistol AR upper here.

I am currently a Nevada Resident with a Nevada Drivers License and registered to vote in Clark county, Only lived here for about 8 months and plan on returning to California in 4 months. Would I still be considered a returning resident?

Probably not, please check Penal Code section 17000(b) (which in turn references Vehicle Code section 12505 for the definition of a resident.

The key issue is whether you maintained a home in California and had an intent to return when absent. If that's the case then you're a returning resident and PC 27585 applies to your importing of weapons.

If you did not maintain a residence while away, then PC 27560 governs.

I did not maintain a home in CA, also had no intent on returning until now

I converted my AR pistol into a rifle lower. I got tired of looking over my shoulders with that thing. We have enough here to deal with without intentionally drawing more attention.

I want the BLM agents to leave me alone.

A maglocked AR pistol, legally imported into California as a new resident, (also be sure the lower was not bought and DROSed in California as a rifle originally) would fetch some decent money on the used market. Not as much now that some people are buying Franklin’s rostered AR bolt action and adding a mag lock and converting it to semi.
