Hello Calguns!

My name is Matthew Cubeiro. I am one of the attorneys with Michel & Associates, and have been with the firearms regulatory compliance and litigation team since 2014. If you don’t already know, our office represents both the National Rifle Association of America and the California Rifle and Pistol Association, Incorporated, in their ongoing efforts to protect the right to keep and bear arms in California.

Many of you have seen prior posts from Clint Monfort and Sean Brady highlighting NRA and CRPA efforts in California. Today, I am pleased to announce that our office has prepared an updated and much more comprehensive NRA and CRPA California Legal Affairs report which is now available.

This report provides an overview of just some of the efforts the NRA and CRPA are taking to protect the rights of California gun owners. Although litigation plays an extremely important role in the fight for the right to keep and bear arms, NRA and CRPA are heavily involved in many other tremendous and equally important endeavors throughout California and across the nation.

As has been and always will be the case, NRA and CRPA invest enormous amounts of resources to protect the Second Amendment at all levels of California’s government, including all 58 counties, all 482 municipalities, and all state and local agencies tasked with enforcing the myriad of complex and ever expanding state and local gun laws.

NEWLY FILED AND SOON TO BE FILED LAWSUITS

NRA and CRPA are working together to file multiple lawsuits challenging multiple anti-gun-owner laws signed by Governor Jerry Brown in July 2016 and passed as part of Proposition 62 (which was overwhelmingly opposed by police). These statutes have become known collectively as “Gunmageddon” among California’s roughly 10 million gun owners, will do nothing to stop terrorists or violent criminals, and infringe on your right to keep and bear arms. Below are just some of these lawsuits that have been filed or will soon be filed:

Lawsuit Challenging the Expanded “Assault Weapon” Ban
SB 880 and AB 1135 expanded the AWCA to include certain semi-automatic firearms equipped with “bullet-buttons” or similar magazine locking devices. This lawsuit, Rupp v. Becerra, challenges the ban on the possession of certain semi-automatic firearms listed by make/model or those firearms equipped with certain “features” as unconstitutional Second Amendment, Due Process Clause, and Takings Clause violations.

Lawsuit Challenging California Department of Justice’s “Assault Weapon” Regulations
This lawsuit challenges proposed regulations for the registration of modern sporting rifles newly misclassified “assault weapons” under SB 880 and AB 1135. DOJ first submitted proposed regulations in December 2016 that far exceeded its regulatory and statutory authority and included over 40 new definitions, burdensome registration requirements, and restrictions on modifications of firearms once registered. NRA and CRPA submitted joint-opposition letters, and DOJ subsequently withdrew their proposal. But on May 15, DOJ re-submitted their proposed regulations without significant changes. This lawsuit, titled Villanueva v. Becerra, challenges DOJ’s proposed regulations as a violation of California’s Administrative Procedures Act.

Lawsuit Challenging the Ban on Possession of Standard Capacity Magazines
SB 1146 and Prop 63 prohibit possession of the magazines that can hold over ten rounds after July 1, 2017. This lawsuit, titled Duncan v. Becerra, challenges the ban on Second Amendment grounds. In June, the District Court granted Plaintiff's motion for an injunction, thereby prohibiting California from enforcing the ban on "possession" of magazines capable of holding more than 10 rounds while the lawsuit is pending.

Lawsuit Challenging Ammunition Sales Registration and Licensing Statutes
Effective January 1, 2019, SB 1235 and Prop 63 require the sale and transfer of ammunition to be conducted through face-to-face transfers and prohibit online orders of ammunition. On July 1, 2019, there will be a background check requirement for purchase of ammunition. This lawsuit will challenge the constitutionality of these laws as violations of the Second Amendment and Commerce Clause.

Lawsuit Challenging DOJ’s Ammunition Sales Registration and Licensing Regulations
The California DOJ has yet to propose regulations to implement these new laws. But when it does, a legal challenge will undoubtedly be called for.

Lawsuit Challenging Los Angeles County’s Public Carry Ban
A new lawsuit, titled Flanagan v. Harris, was filed in direct response to the “en banc” panel opinion in Peruta. This lawsuit seeks to strike down the complete prohibition on the right of law-abiding citizens to carry a firearm for self-defense that exists in many local jurisdictions.

FIREARMS LITIGATION

The litigation report provides a brief overview and update on NRA and CRPA’s recent litigation efforts in California, including amicus and consulting support in other firearm related cases throughout the United States.


NRA/CRPA California and 9th Circuit Litigation Matters

Rupp v. Becerra – Challenge to California’s “assault weapon” restrictions. Filed on April 24 in response to Senate Bill 880 and Assembly Bill 1135. Plaintiffs have filed a motion for preliminary injunction against the requirement that individuals provide date and source of acquisition information as a condition of registration. A decision on that motion is currently pending. http://michellawyers.com/rupp-v-becerra/

Duncan v. Becerra – Challenge to California’s standard capacity magazines restrictions. Filed on May 17 in response to Senate Bill 1446 and Proposition 63. On June 29, the Court granted Plaintiffs motion for preliminary injunction, which has stayed the enforcement of the magazine "possession" ban while the case is litigated. The California Attorney General has appealed the injunction to the Ninth Circuit. Meanwhile, the case is progressing on the merits in the District court. http://michellawyers.com/duncan-v-becerra/

Villanueva v. Becerra - Challenge to DOJ's "assault weapon" registration regulations as a violation of California's Administrative Procedures Act. Plaintiffs have filed a motion for preliminary injunction, seeking to stay enforcement of the regulations while the lawsuit is pending. A hearing on the motion is currently scheduled for January 30. http://michellawyers.com/villanueva-v-becerra/

Flanagan v. Becerra – Challenge to CA and Los Angeles firearm carry restrictions that prohibit both open and concealed carry. This case was filed on August 17, 2016 as a direct response to the “en banc” Peruta decision. The suit seeks to force the court to decide whether or not it is willing to uphold a complete prohibition on the right of law-abiding citizens to carry a firearm for self-defense. http://michellawyers.com/michelle-fl...-harris-et-al/.

Bauer v. Becerra – Challenge to CA DOJ’s excessive DROS fees that generated a massive surplus. On June 1, the 9th Circuit affirmed the district court opinion. Plaintiffs have filed a petition for review to the United States Supreme Court. A decision on that petition is currently pending. http://michellawyers.com/barry-bauer...justice-et-al/.

Gentry v. Becerra – Challenges CA DOJ’s use of the DROS surplus to fund the Armed Prohibited Person System database. On August 9, 2017, the district court issued a ruling granting Plaintiffs’ request to prohibit DOJ from using DROS fees to fund unrelated law enforcement efforts and requiring DOJ to perform its statutorily required review of the current $19 fee to determine whether it is “no more than necessary to fund” DOJ’s costs for processing DROS transactions. http://michellawyers.com/gentry-v-harris/.

Belemjian v. Becerra – Challenge to CA DOJ’s underground regulations regarding the Firearm Safety Certificate Program. This case forced DOJ to finally begin the process of enacting proper regulations for the program in February 2015. Briefing concerning attorneys’ fees has been completed, and oral arguments are expected to take place later this year. http://michellawyers.com/kim-belemji...-harris-et-al/.

Parker v. California – Vagueness challenge to AB 962’s “handgun ammunition” sales registration requirement and mail order ban. As a result of Prop 63, the California Supreme Court dismissed its review of the Court of Appeals’ opinion that upheld the trial court’s order striking down AB 962. The Court of Appeals decision now stands as the final opinion in the case and Plaintiffs will seek recovery of their attorneys’ fees. An additional lawsuit challenging the recently enacted ammunition sales restrictions will soon be filed.


California and 9th Circuit Amicus and Consulting Support

In addition to the previously mentioned cases, NRA and CRPA regularly provide consulting advice and prepare amicus curiae of “friend of the court” briefs in a number of other firearm related cases. NRA and CRPA have supported or will be supporting the following cases.

Teixeira v. Alameda County – Challenge to the county’s FFL zoning restrictions. On October 10, 2017, an 11-judge “en banc” panel of the 9th Circuit issued an opinion which held that the Second Amendment does not protect a right to sell firearms, and that as a result, Alameda County’s ordinance does not unconstitutionally burden the right to keep and bear arms. Plaintiffs have petitioned the United States Supreme Court for review. A decision on that petition is currently pending. http://michellawyers.com/wp-content/...f-NRA-CRPA.pdf.

Pena v. Lindley – Challenge to California’s handgun roster. In July 2015, NRA and CRPA attorneys filed an amicus brief in the case. Oral arguments were held on March 16, and the case is currently awaiting a decision.http://michellawyers.com/wp-content/...d-Reversal.pdf.

Silvester v. Becerra – Challenge to California’s 10-day wait as applied to current firearm owners. In December 2016, the 9th Circuit issued its decision upholding the restriction. On April 4, the 9th Circuit denied Plaintiff’s petition for “en banc” review. Plaintiffs have petitioned the United States Supreme Court for review. Tracy Rifle and Pistol v. Becerra – First Amendment challenge to California’s handgun advertising ban. In July 2015, the district court denied a request to prohibit enforcement while the case proceeds. That decision was upheld by the 9th Circuit in February 2016. NSSF v. Pleasant Hill – Challenge to the City’s restrictive FFL zoning ordinance. The case has been settled, with the City agreeing to pay NSSF over $400,000 in legal fees. http://crpa.org/pleasant-hill-agrees...ing-ordinance/.

Doe v. Becerra – Challenges DOJ’s underground regulation barring the sale of more than one handgun in 30 days to COE holders. The California trial court upheld DOJ’s regulation and the plaintiffs have appealed the decision to the California Court of Appeals. Nesbitt v. U.S. Army Corps of Engineers – Challenge to the ban on possession and carriage of firearms on recreational Army Corps’ lands. The Army Corps of Engineers is reconsidering its firearms policy, and will work with plaintiffs to settle the matter outside of court. http://michellawyers.com/morris-v-u-...-of-engineers/.

NSSF v. California – State court challenge to California’s microstamping requirements. On March 22, the California Supreme Court agreed to rehear the case following a petition from the State of California. National Cases with California Interest

NRA and CRPA also litigate and provide assistance in a number of critical Second Amendment cases across the country that could set precedent for future challenges to California gun laws. The following are some of the more recent and significant examples of these cases.

Kolbe v. Hogan – Challenge to Maryland’s ban on “assault weapons” and 10+ round magazines. In April 2016, the CRPA Foundation filed an amicus brief in this NRA-supported case. On February 21, an “en banc” panel of the 4th Circuit issued an opinion upholding Maryland’s ban, referring to the most popular rifles in America as “exceptionally lethal weapons of war.” The United State Supreme Court declined to rehear the case. Although the “en banc” decision is now final, other lawsuits challenging similar restrictions (such as Rupp) are currently pending, and will provide another opportunity for the Supreme Court hear an “assault weapon” lawsuit. http://michellawyers.com/kolbe-v-omalley/.

Grace v. District of Columbia – Challenge to Washington D.C.’s “good reason” requirement for the issuance of a CCW. On July 25, the D.C. Circuit issued its decision declaring Washington D.C.’s “good reason” requirement for the issuance of a CCW as a violation of the Second Amendment. The Court also issued a permanent injunction prohibiting D.C. from enforcing the requirement. Washington D.C.’s Attorney General decided to not petition the case to the United States Supreme Court. LOCAL ORDINANCE PROJECT

In addition to monitoring all of California’s local jurisdictions and opposing any proposed anti-gun ordinance, LOP efforts include developing and working with a network of professionals, citizens, local government officials, and law enforcement professionals to effectively oppose any local threats to California gun owners.

Opposition campaigns typically include the preparation of opposition or pre-litigation demand letters, grassroots coordination, public information campaigns, and, in some cases, appearances at city council hearings. In many instances, these efforts have prompted local governments to vote down proposals or pull them from consideration. LOP efforts also serve as the foundation for NRA and CRPA litigation efforts against municipalities that enact anti-gun legislation. Recent LOP efforts include:

Statewide Local Elections – LOP continually develops and maintains detailed voting histories of local politicians, including whether they proposed or supported any firearm-related legislation. These records are used to create local election voting guides for members. The most recent of such guides can be viewed online at http://crpa.org/local-elections/.

LA City's Ban on Sales of Ultracompact Handguns - For years, Los Angeles prohibited the sale or transfer of "ultracompact" firearms, even those listed on DOJ's handgun roster. NRA and CRPA attorneys submitted a pre-litigation demand letter in September 2016. As a result of that letter, the Los Angeles City Council voted to repeal the ordinance, which is no longer in effect as of October 15, 2017.

San Carlos Moratorium on Firearm Retailers - The City of San Carlos recently proposed and adopted a moratorium on firearm retailer businesses as a result of several anti-gun residents complaining of a newly proposed Turner's Outdoorsman set to open in November 2017. NRA and CRPA alerted members and submitted a letter of opposition, but the City Council ultimately approved the moratorium on a 4/5ths vote.

Moraga – In November 2017,the Moraga Town Council proposed a mandatory locked-storage ordinance. NRA and CRPA attorneys alerted members and submitted a letter of opposition. As a result, the Town Council pulled the proposed ordinance from consideration, but is expected to reintroduce the proposal in 2018.

Sonoma County – In October 2016, the Sonoma County Sheriff sought approval from the Board of Supervisors to increase the psychological testing fee for CCW applicants from $150 to $550. LOP submitted an opposition letter, and as a result, the Board pulled the proposal from consideration and stated it has no plans to pursue the matter further. http://michellawyers.com/wp-content/...-Psyc-Test.pdf.

Belvedere – In September 2016, the City introduced an ordinance mandating the locked storage of all handguns kept at one’s home, but only providing an exception for CCW holders (which no Belvedere resident has thanks to the sheriff’s restrictive issuance policy). LOP submitted an opposition letter, and in October the City agreed to amend the ordinance to at least include an exception for all law-abiding citizens when carrying the firearm. http://michellawyers.com/wp-content/...cipal-Code.pdf.

El Cerrito – Under the City’s “Master Fee Schedule,” individuals applying for a CCW through the El Cerrito Police Department must pay $961 for a local processing fee, well in excess of the $100 cap. LOP submitted a pre-litigation demand letter seeking repeal of the excessive fee, to which the City agreed and will soon introduce a resolution for repeal. http://michellawyers.com/wp-content/...Permit-Fee.pdf.

San Jose – In September 2016, the City’s Rules and Open Government Committee voted to pursue a mandatory locked-storage ordinance. NRA and CRPA attorneys alerted members to the proposal, and submitted a letter of opposition. The City Council ultimately voted 6-5 in favor of adopting the ordinance, but not before serious questions were raised about the previse language of the ordinance as highlighted by the opposition letter. http://crpa.org/san-jose-rules-open-...rms-ordinance/.

Orange County – At this time, there are over 12,500 active CCW permits issued by the Orange County Sheriffs Department. But many residents of Orange County are still unclear as to the Sheriff’s "good cause" policy. In response, LOP drafted a comprehensive guide outlining the entire application process including what is required to satisfy the Sheriff’s “good cause” policy. Cupertino – On January 12, the Cupertino Public Safety Commission held an open discussion on several anti-gun proposals. LOP alerted NRA and CRPA members, and submitted an opposition letter on behalf of NRA and CRPA members. http://michellawyers.com/wp-content/...OPPOSITION.pdf. The Commission ultimately failed to reach a consensus, but the proposal could still come before the City Council at any time.

Buenaventura – On March 20, the City Council held an open discussion on a proposed ordinance requiring FFLs to install vehicle impact security devices in the form of “bollards” at all entrances. LOP alerted members to attend and submitted an opposition letter informing the City of the ordinance’s serious legal problems. The City Council discussed the LOP opposition letter during the meeting, but ultimately voted 6-1 in favor of the ordinance.

Statewide Public Record Requests – LOP regularly seeks public records in connection with local anti-gun efforts in California. Responses to these requests often yield valuable results, such as which government officials are working with anti-gun groups, sources of funding, and other important information.

REGULATORY MATTERS

Ongoing regulatory matters include drafting regulatory comment letters, providing legal support to NRA and CRPA lobbyists, drafting NRA and CRPA member alerts, and providing advice to NRA and CRPA members. Regulatory Counsel is also responsible for many of the recently published webinars available on the CRPA’s website which provide gun owners with a comprehensive analysis of recently enacted legislation and the recently proposed “assault weapon” regulations from the California Department of Justice. Recent regulatory efforts include:

DOJ's "Bullet Button Assault Weapon" Regulations - After several failed attempts, DOJ resubmitted "assault weapon" registration regulations without any substantive changes. The Office of Administrative Law ultimately approved DOJ's regulations, but not before NRA and CRPA attorneys submitted multiple letters of opposition which can be viewed here, here, and here. The regulations are now being challenged in the Villanueva lawsuit as a violation of California's Administrative Procedures Act.

DOJ's Proposed Expansion of "Assault Weapon" Definition Regulations - In November 2017, DOJ proposed a regulation that will expand the definitions applicable to "assault weapon" registrations to apply in all circumstances, including enforcement of California's "assault weapon" restrictions. NRA and CRPA attorneys alerted members to the proposal, and have submitted a letter of comment. DOJ must now issue a Final Statement of Reasons responding to public comments before submitting the proposal to the Office of Administrative Law.

DOJ's Ammunition Vendor Licensing Regulations - This year, a number of regulations regarding the issuance of required ammunition vendor licenses have been enacted by DOJ. NRA and CRPA attorneys submitted a letter of comment on the regulations while they were pending, and are continuing to monitor their implementation. Additional regulations regarding the sale and transfer of ammunition are expected to be proposed by DOJ later this year.

Public record requests – NRA and CRPA regularly seek and obtain public records from DOJ and local law enforcement relating to internal agency policies and interpretations of California firearm laws. Recently, responses to these requests provided key financial analysis reports regarding proposed firearm legislation, which were subsequently used in drafting legislative opposition letters and veto requests to the governor.

New California Gun Laws – NRA and CRPA regularly work to provide Californian’s with up-to-date information on California laws, regulations, and policies regarding firearms to help gun owners avoid prosecution and retainer their right to keep and bear arms. In connection with these efforts, NRA and CRPA produce webinars on a variety of topics, including the loaning of firearms, the new “assault weapon” laws, the new ammunition sales laws, and the recently proposed “assault weapon” regulations.

Assistance for California members – NRA and CRPA have a variety of resources available to members, including the ability to refer individuals to attorneys specializing in firearm laws. http://crpa.org/resources/.

Implementation of Proposition 63 – Beginning January 1, 2018, courts will require those convicted of firearm prohibiting offenses to turn in/transfer firearms pursuant to Prop 63. To better inform the courts and members of the public regarding this process, NRA And CRPA prepared and submitted a letter of comment to the Judicial Council of California. NRA and CRPA are continuing to monitor the implementation of Prop 63 and will submit further letters of comment as needed.

DOJ Website Errors - This year, new laws regarding firearm warning labels that reference DOJ's website have taken effect. DOJ's website, however, is woefully out-of-date. NRA and CRPA attorneys have submitted a letter to the Attorney General highlighting the many inaccurate legal statements on DOJ's website and the need for correction.

Assistance to gun clubs and youth groups – NRA and CRPA are currently assisting Firearm clubs and youth groups with navigating California’s many complex requirements regarding firearms and how best to avoid unintentional violations of California law.

California’s Firearm Violence Research Center – California has granted $5 million to create the “California Firearm Violence Research Center.” The individual chosen to head this center is a known anti-Second Amendment activist. NRA and CRPA will continue to monitor the center’s activities to ensure taxpayer money is not wasted on biased and unsubstantiated research.

HUNTING MATTERS

Closely related to Regulatory Matters are NRA and CRPA’s efforts to monitor and respond to issues impacting hunters throughout California. These efforts include developing strategies and taking action when necessary before the Legislature, Fish & Game Commission, local municipalities, and other various regulatory agencies. Recent hunting efforts include:

Coalition building – NRA and CRPA recently held two full days of presentations to California hunting groups laying out the plan for addressing attacks on hunting rights in California. The groups unanimously formed a coalition and will be working together in the future to protect hunting rights here in California.

Membership alerts – NRA and CRPA regularly prepare alerts for members regarding new hunting rules and regulations, and to encourage participation at Fish & Game Commission and Wildlife Resources Committee meetings.

Opposition to anti-hunting regulations – NRA and CRPA have prepared and submitted several petitions to repeal or amend current regulations that negatively affect hunters and to promote the adoption of regulations that benefit hunters. Most recently, petitions demanding transparency and structure for Fish & Game Commission operations and to allow archery hunters to carry side arms were submitted.

Opposition to HSUS predator policies – NRA and CRPA continually challenge HSUS regarding non-lethal coyote policies in cities where pets and family members are being attacked, and are working to broaden the coalition of individuals and groups opposed to HSUS policies in light of the dangers to typical family households.

RANGE MATTERS

Last but not least, NRA and CRPA continually monitor environmental, land use, and design and safety issues that heavily affect shooting ranges and areas in California and throughout the nation. Range assistance efforts include regular range evaluations and meetings with Club Boards to strategize and assist with coordination of defense campaigns against “not in my backyard” efforts from anti-gun environmental groups, state and federal agencies, and municipal governments. Recent range efforts include:

Stormwater runoff – Recently, the California Water Quality Control Board has been inspecting all shooting ranges in the central valley area for potential lead contamination in stormwater runoff. NRA and CRPA range efforts have worked with ranges to ensure the Board is using the proper standards in its inspections.

Non-conforming “Use Status” and “Use Intensification” – Local jurisdictions are attempting to break the grandfathered status of many ranges as a non-conforming use under local ordinances. NRA and CRPA are working with ranges to defend their grandfather status which is crucial in keeping ranges open and operating.


FULL TIME LOBBYING EFFORTS

In addition, don’t forget that NRA and CRPA both employ full time lobbyists in Sacramento to fight on behalf of gun owners in the California Legislature. Every year, NRA and CRPA prepare comprehensive legislative updates and voting guides for local, state, and national elections, all of which are freely available online at www.crpa.org.

Also, if you live in or around Orange County, stop by the new CRPA Training Center on February 11 between 10am and 2pm to learn more about the new Coalition of Orange County Gun Owners. It does get a bit daunting for the MAPC lawyers, CRPA staff, and NRA California staff all to be working SO HARD and then get crap from people who don't realize all that's being done, or worse, know but would rather others didn't know so they can keep fundraising for their largely redundant efforts.

Easiest way to donate is at CRPA.org.

CRPA and NRA coordinate their funds for these and other efforts, and NRA spends every dollar raised from California in California. So if you would rather give directly to NRA, that's great too.

I have known about their close coordination but didn't know the NRA spends every dollar raised in California in California. Great write up! Many year NRA member and just recently joined CRPA. Had no idea you guys were doing this much work. May all non-members of NRA/CRPA/CGF etc, read this and be willing to donate the $35 or so for said memberships. This is the time to support our rights. How much do we spend on ammo, guns, range trips compared to $35? We love to complain AFTER we've lost more rights, but did we support those who have the skills/ability to affect positive change/defend those rights such as described by Matthew?

Quick question. The newsletter mentions that litigation against the statewide ban on LCM possession is being prepared. Is the goal to seek an injunction before 7/1 when everyone has to dispose of them all?

I have also updated the first post to include information on the lawsuits that concern "gunmageddon" and Prop 63, as well as those cases related to Peruta which seek to bring "shall-issue" to California and other states with restrictive carry schemes.
