Thumbs down Appointment with the SD Sheriff for CCW - APPEAL DENIED - Post #103

OK, I know I don't have a chance in hell, but, I figured, why not? They are close to where I work, I already filled out the CCW form, so...

No, I don't have a good carry statement other than self-defense. She told me there's no fee for the interview, so, I guess we'll see when they deny me on the spot next Wednesday!

Just thought I'd share...I followed all the info on this site for how to apply, being truthful to an car accident I had (solo, no injuries), plus other stuff...I listed my 2 Springfield's as the guns to carry - one XD 9, and the other XDm 45. I know they will deny it, but

Other than a good attitude, respect, and dressing appropriately, anything else I should know before I go??

Thanks. I actually called the Sheriff's office to ask if I apply for a CCW there, or at the SD Police - since I live in an incorporated area - million+ people.

First thing she asked is if I wanted an appointment to apply...Well, sure!

I'm not even gonna wish you luck, because everyone knows that Gore doesn't issue. Thankfully my primary residence is in Sac County, or I wouldn't be CCW'ing in SD County at all. Gore wants to make sure the 3.2 million sheeple in SD County can be controlled.

OK, just got back from the San Diego Sheriff's office and here's the lowdown:

First, they take no paperwork from you at all, other than taking your driver's license and making a copy of it. They ask you questions (jail, military experience, LE applications, if I owned any firearms, etc.), and ask why you want a CCW. She took notes on this. When I told her for self-preservation/protection, she referred me to the section in the application where it explains if you are applying for those reason, you need to attach reports, actual incidents, names, locations, etc. I told her I didn't have any of those and wanted to protect myself before those things happened. She said there would be a HIGH likelihood it would get denied. I told her I knew that, but wanted to proceed anyway.

OK, she then walked through the procedure, said I needed to fill out the application, in full, make another appointment, with her, bring a check for $105.63 for fingerprinting and fees, and she would submit my application. She then said it would go to a review board, and they would make the decision and get back to me by mail. Also, to bring in 2 forms of residency dated within the last 30 days, other than your driver's license.

She also said the application I brought with me was old - I got it off the San Diego CGN site in this forum. The new one is here: http://www.sdsheriff.net/licensing/ccw.html

So, I will fill out the new one, write a check, get a couple of bank statements, make an appointment and go from there!

While I was there, I saw someone there to renew their current CCW, and a new applicant, a woman, to get a CCW. No info on these people, just noted.

I'll keep you posted!
Again, I don't expect to get a CCW from this...just walking through the procedure.

Thanks all! Now, to time the next appointment with my bank statements! They are coming up on 30 days old. Since I rent, I don't have utility bills in my name & address. I will ask if a cell phone bill works when I call her back on Friday to set an appointment for the 1st week of October.

The application sheet states: Two proofs of residenct must have the applicant's name, such as monthly utility bills, receipts, etc. dated withing the last 30 days. Post Office box numbers are not accepted as permanent residence addresses.

Since I rent, and don't own the house I live in, I have NO utility statements. She told me that monthly bank statements - from 2 different banks - would suffice. I'm going to give her 1 bank statement, and my cell phone bill. That should work.

Just so you know... there isn't a "high" likelihood you'll be denied, it's a certainty. Why? Because if they issue to one person "for personal protection", that opens the door to equal protection lawsuits, and when they lose that, they lose their discretion.

I'd go down and apply too, to make the point... but I can't see tossing $105 down a well hole. It would be great to get a few hundred people down there all applying, though!

OK, so, 2nd appointment done. Application submitted - got a comment from the clerk after reading my reason for a CCW - "well, I've never read one like that before!" Anyway, the clerk has nothing to do with it actually, they just gather the documentation, etc., and it goes from there.

Fingerprints done, picture taken, money taken. Now, she told me it would be assigned to "Brad", who would be gathering the info from the DOJ & FBI - based on my fingerprints and background check. he may call me with further questions, based on my report; ask me to come in to change something on the application; go to my home to see that I actually live there, etc. This should be in the next 30 days.

After Brad's report is done, the whole mess goes to a panel - where they reject it.

SO, the question is - is anyone - like the CalGun lawyers - gathering this info into a larger suit in the courts over infringement of rights based on the Constitution? Are they gathering up hundreds of these same rejections or something? That's what we should be doing...

OK, back to FAXing, calling, e-mailing the Governor...

The only thing I've seen in that regard is a compilation of Good Cause Statements for certain counties (San Diego included) posted. That was quite a while ago.

No, because the rejections under the current system aren't a problem. The law allows them to use "good cause" as a cop-out, and they've decided that your cause is not good enough. Since there is no legal standard for what constitutes "good cause", there is nothing to argue the point that it's whatever they say it is.

If you had the $$$, you could retain an attorney and sue... but that's already been done in Peruta v. San Diego, which has been winding it's way through the courts for several years now. IMO, a new lawsuit based on equal protection grounds... "Other Californians have CCWs issued for personal protection, it's a violation of my rights to deny me one for the same reason" might hold water, but probably only at a Federal level. State would simply disagree with you and say a CCW is a privilege, not a right, so you have no standing.

Again, my opinion... donate to SAF. They're a big part of the lawsuits that are slowly killing may-issue. They're behind Woollard, which is awaiting a writ of certiorari from SCOTUS, and a victory there will quickly kill may-issue here.

But who knows, maybe someone will slip up and hit your paperwork with the wrong stamp, and you'll open the floodgates for us! :-D

Yup, and they were all "special citizens"... ex-cops, judges, DAs, people with the "right" kinds of business. I read through most of them, eager to find a chink... but since they've routinely denied for "personal protection", they get to keep on doing so until the courts force a change or San Diego voters wake up and elect a decent Sheriff. I really hope in the next election someone makes a big case over how the office was given to Gore. It was beyond disgusting to watch. No better than how Saddam's kids got cool toys in Iraq before we cleaned their clocks.
