Default CA guard members asked to give back bonuses!!??

CA Guard members are being forced to pay back re-enlistment bonuses?

This is the most outrageous thing I've ever seen. Induce someone with cash to risk life and limb. A guy suffers from an IED, than they slam him with penalties and interest for a bonus he acted on in good faith?

It's outrageous.

Yeah, there's another thread about it in the OT. I don't know why they didn't just use part of the budget. I think the soldiers should just get a attorney and do a class action against the state of CA.

I think they have a very good case. That's simply outrageous. I think there's good case law to support their claims.

Not sure about the California National Guard but, I do know that the Navy as well as the other branches of service have procedures in effect for a serviceman to request a waiver of indebtedness to the government when over-payments like the one described by the OP are made. This would certainly be something in inquire about of one's finance or disbursing officer especially given the fact that the over-payment was made due to no fault of the member.

This needs to be fixed. People induced by fraud to sign a contract they perform and than asked to repay??

Can we not agree this is perhaps the most disgusting government action one could possibly imagine? I mean, its not even close to shooting up a indian village of women and children but its pretty messed up. Why would anyone fight for our country when veterens get treated like this???

That is true I have seen it happen to one of my soldiers. I guess I was audited because I received a letter from the guard stating that a review of my enlistment bonus had been conducted and everything was fine and in order. It was on an official letterhead signed by a Colonel.

Reps in congress knew about this, and have been asked by CA Natl Guard to help mitigate the damage to the enlisted BUT REFUSED to help. This means the ENTIRE congressional delegation from California was contacted.

So now it's PR CYA. NOTHING MORE.

Yep, there are just too many layers of bureaucracy between signing the contract, and the money getting in the soldier's checking account for one layer to be the cause of this.

So this would mean not one single soldier who came on through these promises could be discharged less than honorable. Absolutely none of them currently in service who are being told to give money back have any further obligation of service and should be given an Honorable DD214 upon demand effective upon the date they request it.

There are just so many options out there for congressmen to pull to leave soldiers stranded high and dry.

I see class action.
