Default Oct 9th BOARD OF SUPERVISORS TO CONSIDER SHOOTING BAN FOR BLM PinkGate/Donohoe Mt

Time to speak up!!!!!!!!

CRPA CALL TO ACTION!

SAN DIEGO COUNTY BOARD OF SUPERVISORS TO CONSIDER RECREATIONAL SHOOTING BAN FOR BLM LAND AT OCTOBER 9 MEETING
On June 26, 2018, Supervisor Dianne Jacob quietly agendized (Item 17); a proposal to ban recreational shooting on BLM land around Donohoe Mountain. Supervisor Jacobís staff report stated that the area known as Donohoe Flats needed to be permanently closed due to a high risk of fire from recreational shooters in the area. However, the only two speakers who showed up to comment on the agenda, both known residual NIMBYS that live close to the area and adjacent to the South Bay Rod & Gun Club, provided testimony that recreational shooting in the area is a safety issue and that both had encountered stray bullets impacting their homes. (No evidence of these occurrences was actually presented to the Board and has yet to be made public) Accordingly, the Board of Supervisors voted unanimously and without any discussion to have staff draft an ordinance permanently banning recreational shooting in the area.

The NRA and CRPA has reached out to the County of San Diego and the BLM to advise them of the legal pitfalls in implementing this type of ordinance.
Nonetheless, the San Diego County Board of Supervisors has indicated that it will add the proposed ordinance to the agenda for the meeting to take place at 9a.m. on October 9, 2018.

Address for the meeting:

Board of Supervisors North Chamber
1600 Pacific Highway
San Diego, CA

If you can attend, it is important that you be at the meeting and voice your support for maintaining accessibility to BLM lands.

We need your help!

Anti-gun groups, NIMBYS, agency bureaucrats and politicians are consistently chipping away at places to exercise your Second Amendment rights. This is a concerted effort that we are seeing across the state of California and the nation. To that end, it is critical that all gun owners and Second Amendment supporters make their voices heard either during the Board of Supervisors meeting or by taking the time to write to the Board members to oppose this proposed ordinance!

What to Say: I oppose the proposed ordinance to permanently stop recreational shooting near Donohoe Mountain and Pink Gate areas. There are already ordinances that protect these areas during high fire danger times and permanently closing these areas to recreational shooting is an attack on lawful activity on federal lands. As a concerned citizen I stand in opposition to the proposed ordinance and ask that the Board of Supervisors vote no on this action.

If you are unable to attend, you can submit written comments using the following information:

Dianne Jacob, Supervisor (Sponsor & Proponent of the Ordinance)- dianne.jacob@sdcounty.ca.gov
Greg Cox, Supervisor - greg.cox@sdcounty.ca.gov
Ron Roberts, Supervisor - http://www.ronroberts.com/content/d4/en/contact.html
Bill Horn, Supervisor - bill.horn@sdcounty.ca.gov
Kristin Gaspar, Supervisor - kristin.gaspar@sdcounty.ca.gov

You may also visit the Board of Supervisors page at https://www.sandiegocounty.gov/conte...neral/bos.html for additional contact information for each Supervisor.

Got the notice from CRPA. I won't be able to attend but I will certainly be writing those listed.

Does a county have the legal authority to stop legal use of federal property?
I think not.

An e-mail I received from San Diego County Gun Owners included a FAQ saying this: "If it is federal land, why can a County Board control what happens there? Apparently, there is an old memo of understanding between the federal government (BLM) and San Diego County. Basically, it states that the feds will follow what the county says in matters like this."

I wonder if the citizens can also contact BLM and complain to them too.

It will close. That last fire there sealed the deal. Too many rural homes in the backcountry now, it's all getting developed. The same thing happened at Orosco Ridge in 2012.

The desert should remain open for a few more years.

Is a "memo of understanding" legally binding? I wonder if it could be challenged in court?

So basically the feds will honor other agencies enforcement of state/local laws and alow LEO access. Example state hunting regs. At no point is a federal agent obligated to enforce state/local regs. For BLM to permanent close an area to recreational shooting requires congress. They been compromising with the fire restrictions. An outright ban from county is illegal. BLM turning a blind eye to local authorities enforcing a ban can bite them in the ***.

Don’t bother trying to convince the locals put the pressure on the feds.

Well I'm going to the meeting even though I've never shot at either of those spots . I will say that the fire danger is real and should be considered but the permanently closing these spots seems like a bit of an over reach .

SDMUST has been fighting this since 2003. Unfortunately I was out of town when the last meeting took place and could not attend to call them out on their misinformation and nonsense. In the PDF from the board , they claim they consulted with BLM, the sheriff, and local residents. but everyone I have contacted said they were not consulted , didn’t know about it, or just heard about it when I called them. I will be at the meeting and will try to call them out on their bull****. SDMust has had hundreds of volunteers clean these areas for many years now . I can honestly say I have spent more time and know those areas better than all the people on the board, and anyone they might have consulted with. They also stated that there is plenty of other available areas open to target shooting in San Diego county , which is a complete lie . Hopefully we have a good turnout on Tuesday .

I called the BLM office and the Supervisors.
BLM agrees that the County has NO AUTHORITY over BLM land.
BLM land belongs to THE PEOPLE and is managed by the BLM for CONGRESS.
THE ONLY ONES WHO CAN MAKE OR CHANGE POLICY ARE CONGRESSMEN/WOMEN.

County Supervisors are full of themselves and exceeding their authority.
San Diego County has NO AUTHORITY over BLM land either in policy or management.

Let them vote for whatever they want. They can NOT stop legal activity on BLM land.

No but for Pink gate they can stop you from parking on the side of the road. Then it is effectively closed, unless they decide to open the gate. Which I've never seen in all the times I've driven by.

I know the vote went against us today and the Board voted to ban shooting, but there currently is no ban. Furthermore....please stay tuned for an announcement about there NOT being a ban ever. The vote they made today will not change anything.
I cannot give you details right now, but I will very soon.

Please help spread the message that there currently is no ban on shooting on BLM land (and there won't be).

Look forward to hearing about this. I just heard about this today on 760 on the drive home; have been pretty out of the loop with life stuff. Was pretty upset to hear about it so late.

We will be discussing this and other local issues at the SDMust Meet+Greet on October 17. We also have maps and directions to local outdoor shooting areas.

Story so far is that the BLM cannot be forced by the Board to close the land to shooting. San Diego County Gun Owners is working with BLM to keep it open. Of course if fire season is 365 days a year were boned.

There are everlasting things going on behind the scenes to fight this . SDMust has been actively working on it as well for a long time. Hopefully there will be some support from the federal government .
