I have NOT read anything in this post...

My experience with my dad's claims and the VA is this - YOU NEED A REPRESENTATIVE TO HELP YOU.

For my dad we went through DAV.

It was a long tough / emotional ride!

We started in Oct 2010 and finished about 2 months ago.

One thing I can tell you is... You need a doctor that is willing to write letters on your behalf CONNECTING your service related injuries to your time serving.

Good luck to all of you.

Thank you all for your service.

I pray you get the care you deserve for your sacrifices.

Joel

They told me it is going to be long road.

19 months in Iraq as a machine gunner (I was the only machine gunner left in my team by end of my deployment) took lot out of me.

Just a word of advice for guys still struggling with their claims some really good options in terms of disability advocates is AMVETS and DAV look up these organizations and dependent on where you live you will get a rep in your area who can help you out in filing a claim or doing what I am doing and filing an appeal to a claim Dissension.

My wife's appeal of her original claim took 26 months. It was a long road, and there is a need to get everything documented at every step, but there is light at the end of the tunnel. And the crazy thing is that they still missed stuff...and forgot to address stuff, so we are going to have to go through it again.

Hang in there everyone... VA is telling me you do not have many documented records in your file and I keep telling them in combat zone no one is there to take notes.

Great.....
I just received my service record file from USMC and they are missing tons of stuff. I have my own copy of some of the recrod (my injury record) at home and files they just gave me has none of my injuries I received while I was in Iraq.

I've sent medical records request to the archives, which they said they don't have my record that the VA has it. Then they sent it to the VA, who said they don't have it, but the local va has it. Waiting for the local VA to tell me they don't have it and I have it lol.

Kind of pissed me off, because not only did they tell me there was no evidence, they cited looking at medical records for years that I was obviously not even in existence (1972-76 vs. my entry of 2002-2012 ).

Just came back from my own private doctor (she told me she feels bad for me). She says, I look so young, but my body is pretty jacked up. I just hope VA settle my case very soon because all this co-pay from VA and my own private insurance is adding up real fast.

Just over 2 years. Much red tape and seemingly unending "homework assignments". Prove you did this. Prove you did that. Proof of deployment. Etc... My thought is they try to grind you into giving up. Don't.

^^^ That is exactly their plan. I have proof of deployment, and a medal you can only get in combat on my DD214, and they still said I had to prove that I was in combat. I kept a log book when I was in the ME, and when I provided them dates of operations I was involved in they backed off. But dealing with them losing records and all the other bull**** continues. I really hate the ****ing VA.

Ok, I was discharged on 11/03/2007. Filed my initial claim 11/05/2007. Submitted a bunch of evidence of legit back injuries, along with some other things. Claim was denied in 2009.
Refiled my claim in Jan 2011 after I was told by the VA and my VSO that there was errors on the VA's part in handling my claim. March 2013 my claim was rated at 60%, with full back pay to when I first filed in Nov 2007. The only thing that they did not approve was my back injuries (2 buldged discs, DDD in 3 discs, and arthritis), due to not having a current medical diagnosis on them. Filed a NOD on the claim, with 43 pages of supporting documentation last week.

Question: For those who have filed a NOD, how long did it take after that? I can already get medical care for my back through the VA due to my rating, but am just ready for all of this back and forth to be over with. It almost seems like they want to make you give up on some issues.

Sad, after serving the country, they just want you to give up.... Also, customer service in VA is terrible.

The VA is so back logged right now it's ridiculous! All new claims or appeals can take a long time for review, and I think the system is being very stringent on upgrading disability ratings.

Yes the fact the WE are required to prove what the government already knows is a joke. Wanna bet if I claimed to be a 5 star with 30+ years of service and that they "owe" me BIG $ there would be some amazing immediate access to records showing that the claim is false...

I strongly feel that is their ultimate goal. Nothing else explains the pure stupidity.

I will say that dealing with the VA is an uphill battle, HOWEVER once you are "in the system" I have found that service and respect is actually somewhat amazing... I know I know. I wouldn't believe it either, until I made it to the other side ("in the system")

Keep pushing. They will relent. Then push some more. Make that x% change to y%

Good luck to all!!

P.S.

To those that served, thank you for your service!!

How long does it take for VA to send you a copy of your medical record? My claim representative from Veteran Service Office needs my medical record so they can help me file my claim.
I hope it does not that long time because all this copay from therapy (I have been going to therapy for my knees, neck, shoulder, feet, and lower back) is adding up real fast.

I think there are emergency forms available. You can also bring your DD214 to the VA and you get treatment for up to five years...

My VA didn't charge me for anything except for medical.

I'm currently being treated for a lot of stuff that isn't in my VA records.

Research your potential problems... don't overdue yourself. Like, I was told after the fact that I should stopped moving when I had pain. But, instead, I kept going as far as I could go even through the pain. Don't be a tough guy like that it doesn't do you any good.

Malaria might be hard to claim because they are going to ask you how is malaria effecting your life right now. I am going through this process right now and everything is about "how and why those injuries making your life difficult?"

Good luck

Hey guys long time lurker here. I filed before I got out of the Army and just recently got approved for 30%, 20 for TBI and 10 for tinnitus. They also awarded me 0% for several claims and a couple were deemed not service related. I thought that was it, until someone told me I could (and should) appeal everything. Two of the things I was awarded 0 for were lacerations requiring stitches that happened in Afghanistan. They were half combat related. I say half because they were not caused by enemy fire, but did happen under contact (separate incident from TBI). A scar on my leg is several inches long and another on my chin is about an inch long. I was very surprised these were not approved.

From what I gathered from my packet, the initial appeal step is to simply send in a letter. I've heard conflicting reports to make a vague appeal and others stating to go into detail. From guys who have been down this road before, what would you recommend I do? I know it'll take some time, but I just want to do it the most efficient and best way possible, especially since I have to deal with our great state's system.

I understand this is my first post and asking for help so I appreciate any who offer it. Thanks in advance.

Pkwydr:

I recommend you see a local VSO at the VFW or DAV or the likes. Have them do your appeal / reconsideration / NOD / whatever they call it. These dude are too notch and their services are generally free.

Literally took me 3 years. Documentation via your service AND your visits to the VA Hospital is soooo essential. Totally agree about appeals.

Also -- I had my Congressman do an official inquiry re: my claim. Few people said it would simply mix up my claim…but strangely, my decision came down one month later.

It was such a frustrating disheartening venture…and I'm an Iraq Vet -- we're supposed to have priority. I can only imagine the hell Vietnam Vets endured. God bless 'em.

Maybe I should write letter to my congressman since he is very pro military veteran.

Damn ok. Was hoping it'd be simple but I guess I shouldn't have expected less lol. I looked up the number I'm going to call tomorrow and see them soon.

On a similar note, I got a letter stating my disability checks could not be sent because of an invalid address (even though I had already received some). I went on eBenefits and it's correct but obviously not for them. I searched for VA address change but everything pointed back to eBenefits. Anyone have a number I can call?

Stop by your local Veteran Service Office and they should direct you to the right place. They usually have all the answers you need and it's free.

Thanks Jack. I have an appointment next week with my local VSO to do my appeal. I was very surprised when he said the appeal could take 3-4 years. He did say they could approve claims right away if there was clear evidence they made a mistake.

I received 24 stitches to my shin and chin in Afghanistan and have pretty gnarly scars from them and I thought those would get approved above anything else as there was crystal clear evidence of the event and records from the hospital but they were both awarded 0%. I have a feeling they will get approved right off the bat but the others will require I head down the appeal road.

On a similar note, I got a letter stating my disability checks could not be sent because of an invalid address (even though I had already received some). I went on eBenefits and it's correct but obviously not for them. I searched for VA address change but everything pointed back to eBenefits. Anyone have a number I can call?
I would give them a call and explain the situation, alot of times I have gotten great help from the phone workers.

Just received another letter from regional San Diego office. They say they can't find my record and need more information. Oh man....

I just hope they can find it soon. All I am waiting is for my medical record so my claim officer from VSO can finish filing the claim.

San Diego VA Regional called me today and gave me a number to call (archives military record). Their customer service told me we do not have your record so try calling VA lol. After calling 5 different number and still no luck. Last customer service from Archives told me to call VA Record Management Center. They were closed so I am going to call them tomorrow. I have been told if they cant find my record then no one cant lol.
