I don't quite get that since the CA DOJ said to use the C&R DROS for modern firearms for collectors, so the system doesn't know it isn't a C&R.

Huh? That says it is just for a C&Rs.

The FSC issue is interesting since if they get a C&R and a modern firearm, you have to be careful, but that is also the fault of the CA DOJ for having it submitted incorrectly.

What I’m getting at is the stystem May not know it’s not a C&R but when they inspect, the law doesn’t say you can use a C&R exemption for FSC on modern guns.

True, you would need to keep a copy of the FSC for the records. This would only be a problem if there are both types of firearms sold (C&R and modern). Otherwise you would have to do the safety demo on a C&R when the person is actually exempt from that.

I just write in the FSC number on the printout and keep a copy of the card.

Default 1/30 C&R AND COE HOLDERS for MODERN firearms

Why wouldn’t you just put the FSC number in the field rather than writing it in and risk the DOJ saying you did it wrong.

You can't change it in-between DROS. If you don't use the exemption then you need the safety demo. It is better to use the exemption and then for the non-C&R have the safety demo paperwork.

My point. If the guy buys a Mauser and a glock you put the FSC and do safe handling affidavit. If you put the FSC EXEMPTION then the DOJ can ding you for using an exemption on a modern gun (even if you have the FSC in the packet I bet they will say you wrote it up wrong).

Just my opinion. I sell thousands of C&Rs a year so it’s my specialty.

Cross it out on the DROS and then put the FSC number on the printout. It isn't our fault that they are having us do it that way and they don't let us change it, but we can change the 4 yes/no questions, as if the person might commit a crime in between submitting the DROS.

I don't think it is a big deal as long as you do the right thing. They know there are problems with the system.

Is there an FFL near Folsom that will adhere to the 1 in 30 exemption of on roster handguns for COE +FFL3 holders?? I’ve asked a couple of dealers about it and they have no clue what I’m talking about.

Ask them to read the bulletin. Often it seems one person reads it and the rest don't get the message.

There's a lot of info in the FFL forum about the 1in30 exemption. I just copied and printed all the howto stuff that seemed important plus a copy of the bulletin.. that they should have received..., and took it to my FFL1. It was a learning curve but we made it through in fairly short order. One thing that's confusing is by having to use the C&R section in the end it also states that you can deliver the gun right away and not have to wait the 10 days, but it doesn't specifically say that anywhere in writing. So even tho it says it's OK, leave it for the 10 days as the jury is still out on that part??

Yes, it is a problem, but there is a waiting period on modern firearms so releasing it early could be a big problem for the FFL. This should be "fixed" with a bulletin, but that unfortunately takes a lot of time to get it approved for release.

I already had a revolver being held for the 30 after buying a couple of out of states, and I had another one on it's way.. Then the timely ruling came down about the exemption for FFL3/COE's. So about 20 days into the 30 my FFL1 did the DROS on the first, and then the second at the same time, saving me a couple of bucks. When the print out came back from the CADOJ, and they were both released. The dealer insisted that I take them both. So not knowing any better I did. Now I leave them for the 10 days just to be on the safe side. But I still wonder if they plan on fixing the glitch, or leaving it up to the buyer and dealer. They certainly have had enough time to correct the problem... If it actually is??

I don't think that they can fix it due to many issues, one is regarding the employee who works on it and not being able to control him, plus it is hard to get changes approved.

The state already limits handgun purchases to one every 30 days. Just to clarify, SB1177 (vetoed by Governor) retained the C&R/COE exemption from 1/30.
