Default FFL03 1 in 30 Day Exemption Question

I am new here and new to having a FFL03. I did a search of the threads but was not able to find an answer to my question.

I understand that there is an exemption from the 1 in 30 day requirement, for collectors (FFL03 Holders) and I have a copy of the bulletin that tells the FFL how to process the transaction to utilize the exemption. It appears that they process the transaction as a Curio and Relic transaction.

My FFL has never heard of this exemption so we are learning it together.

But what is not clear to me is if I need to put it in my bound book or not? In this case I will be buying 2 modern pistols, one is on Roster, one is Roster exempt. Neither is a Curio or Relic.

But my understanding is that the FFL01 will be processing them as a Curio and Relic transaction. Or at least the second one will be, to utilize the exemption.

So would they go in the book?

Any help would be greatly appreciated.

You are exempt, I would processes many handguns for you as you wanted in one shot brand new even. He needs to review his Des bulletins

Non C&R guns do not go in the bound book, at least not my book.

However I do log all my C&R guns into my book no matter how I obtained them (using a dealer or not).

I read in the past (thread on CG), few said if 03 was used even for modern handguns in conjunction with COE, log it in.

Great question OP as I want hear what everyone is doing on this.

Yes, but if you DROS you don't need to send DOJ $19. I'd rather give that to my local any day.

But a 03+COE 1 in 30 exemption is a state exemption, not a federal exemption. And the bound book is a federal requirement and they could give two flips about our stupid state laws.

What’s next, logging in ammo we get with 03 FFL + COE? That is a rhetorical question...

The answer of course, is no. For both...

Thanks for all the responses.

I am glad that I am not the only one that was confused by this.

It would seem to me that Skyhawk is correct, the book is a Federal Book and the 1 in 30 day restriction is a State restriction. So, although I am using my FFL03 as part of the transaction, I am only using it for a State restriction. So, it would not go in the book.

Got to love confusing CA laws. However, O do love the 1 in 30 exemption!!! :-)

As posted only C&R firearms get listed in your bound book; even if DROSed.

Modern firearms even purchased using your FFL03/COE do not get listed.

Thanks Hawk. It makes perfect sense as 03 is federal and 1/30 is an CA thing as I was just curious upon reading previous threads.

You do not log non-C&R guns in your bound book. The only reason that your FFL enters them as a C&R in DROS is because CA DOJ is too lazy to update the DROS program to recognize the 1 in 30 exemption for those holding a 03FFL and COE. Instead they have the FFL falsely indicate modern weapons in DROS as C&R to get around the faulty DROS program.

Does this apply to Intra-Familial Transfers as well? My wife has a COE/FFL03, and the CA DOJ told our FFL that she could not receive more than one IFT in a 30-day period unless it was an actual C&R.
It would appear from the posts in this thread that this isn't true.

IFT is exempt from 1 in 30 regardless. We've had to argue this over and over with DOJ. We will do any number at a time, no problem. Still a 10 day wait of course, you don't even need an FFL03 for this.
