Default ccw permit (Peruta, Oral Arguments June 16th in SF)

Idk if this has been adressed but hows everything going with the concealed weapons permit here in san diego??

A larger panel in the 9th Circuit Court of Appeals is rehearing the case. It will be heard by an 11-judge panel, versus the original 3-judge panel.

Oral Arguments will take place June 16th, 2015 in San Francisco. A decision from the larger panel could be released anytime after. Hopefully before the end of 2015, but we won't know until it happens.

Keep waiting zombie, keep waiting.

If I had to guess the fix is in from the 9th circuit. Our only hope will be from the SCOTUS, but they will punt like they have with most (all?) 2A cases since Heller. Just my opinion.

Now that they've named the judges, does anyone know how friendly the court will be towards 2a?

About as friendly as they have been. I expect this issue to die a death in the 9th with no SCOTUS taking it up.

Back to square one.

Hopefully some of the scathing words from dissent in Jackson by Roberts and Thomas about the lower courts not applying the historical analysis test they mandated in Heller will get the attention of the En Banc panel, and perhaps even quoted/cited by plaintiff's counsel during orals.

I pulled this from the larger Peruta thread. 8 judges appointed by a D president, and 3 judges appointed by an R president. Party lines don't mean anything, although IIRC KcBrown posted that there has been a total of zero D judges that have supported a 2A ruling at the appeals level (although there have not been a ton of rulings).

Don't hold your breath for a victory here. I think the best we will get is an scathing dissent when they rule against us, and hopefully it is enough to sway Roberts/Alito/Kennedy to grant cert at SCOTUS. (Scalia and Thomas are already on board)
