Default I have to return mags...

Because of my own mistake. An unfortunate one.

I ordered the wrong CZ mags. I ordered Weds but was in such a hurry to get the order off I picked the wrong ones. Now I have to return them unfortunately and I'm assuming they won't do an exchange but simply process a return.

Anyone else run into this issue?

Don’t assume anything. Some businesses have strict no refund policies for magapalooza.

reach out to them and see what they say. I think every vendor will have different policies.

An exchange wouldn't be a sale, so sounds like it would still be legal.

An exchange at this late date might be seen as importation.

Unless the vendor's a brick-and-mortar already doing biz in CA.

What say ye, o calgunnicus maximii? ( <--- that's plural for ye o great calguns collective, loosely speaking)

I did the same thing. I ended up blocking mine to fit 10 and see if I can trade for the right ones. Somehow i think I’ll just end up selling them if I can’t find someone to trade with.

I briefly thought about “getting the right gun” but honestly there’s so many other guns I want ahead of it that I’m not really interested in the idea.

I can guarantee it's not legal. He can return the mag legally as it's just sending the mag out of state. But bringing a new mag into state is explicitly illegal at this point. If they shipped him the wrong mag, one might be able to argue that the mag he bought, which would be covered under the injunction, would be legal to import even now (which would probably make receiving the wrong one a crime??). But since he received the mag he bought, he cannot get it exchanged.

If they'll take a return, that's your only option with the seller. Otherwise, the other suggestions made here are quite good:
1) buy the right gun
2) block the mag and sell it to someone who will appreciate it

I guess the opinion that those who bought a magazine during freedom week are able to do so forever is becoming less popular

Exactly. If we are guilty of anything on CG, we are guilty of the tail that wags the dog. I have always bought ammo for calibers I don't own. Mags for guns we don't own, became a very common practice several weeks ago.

The wording of the order, strictly interpreted, seems to indicate so.
Quote:
IT IS HEREBY FURTHER ORDERED that the permanent injunction enjoining enforcement of California Penal Code §32310 (a) and (b)shall remain in effect for those persons and business entities who have manufactured, imported, sold, or bought magazines able to hold more than 10 rounds between the entry of this Court’s injunction on March 29, 2019and 5:00 p.m., Friday, April 5, 2019.
Syntactically, it reads as if the judge has prevented the DoJ from enforcing 32310 against certain persons- said persons identified by having legally bought magazines in the allowed period. Again, syntactically, the judge didn't prohibit prosecution of actions committed between said dates, but for people , identified by having committed an action between said dates

But both the judge and Chuck Michel have made their intent and interpretation of the injunction crystal clear.
Benitez:
Quote:
In layman’s terms, the State of California and the law enforcement agencies therein will be free to re-start the enforcement of Calif. Penal Code §32310 (a) and (b) which currently prohibits, among other things, any person in the state from manufacturing, importing into the state, offering for sale, giving, lending, buying, or receiving a firearm magazine able to hold more than 10 rounds (as defined by Calif. Penal Code §16740).
Any person. Not just those not identified as "protected"

Chuck Michel:
https://www.nratv.com/videos/stinchf...-in-california

In the end, it's up to a judge to interpret the order and determine if you broke the law. Feel like rolling those dice? I don't.

This is misinformation:

It is true that Judge Benitez wrote:-

"In layman’s terms, the State of California and the law enforcement agencies therein will be free to re-start the enforcement of Calif. This will continue until the appeal proceedings conclude or the stay is modified or lifted."

But that was his conclusion with regards to :-

"THEREFORE, IT IS HEREBY ORDERED that the Judgment is stayed in part pending final resolution of the appeal from the Judgment. The permanent injunction enjoining enforcement of California Penal Code §32310(a) and (b)is hereby stayed, effective 5:00 p.m., Friday, April 5, 2019"

About :-

"IT IS HEREBY FURTHER ORDERED that the permanent injunction enjoining enforcement of California Penal Code §32310 (a) and (b)shall remain in effect for those persons and business entities who have manufactured, imported, sold, or bought magazines able to hold more than 10 rounds between the entry of this Court’s injunction on March 29, 2019and 5:00 p.m., Friday, April 5, 2019.Dated:"

He had to say:-

"Both parties indicate in briefing that persons and business entities in California may have manufactured, imported, sold, or bought magazines able to hold more than 10 rounds since the entry of this Court’s injunction on March 29, 2019 and in reliance on the injunction. Indeed, it is the reason that the Attorney General seeks urgent relief in the form of a stay pending appeal. Both parties suggest that it is appropriate to fashion protection for these law-abiding persons."

Maybe we need a flowchart?

Keep the mags. There is a high probability that you’ll want to buy the CZ size that takes those mags eventually.

What mags did you buy? Tell us, and we can start to convince you to buy something that uses them.

The way I structured it? That's a new one.

Nevertheless, my response to SanDiego619 still stands: Chuck Michel has stated his opinion that it is not legal to "manufacture or cause to be manufactured, import into the state, keep for sale, or offer or expose for sale, or give, lend, buy, or receive" >10rnd mags at this point.

Benitez’ stay has the provision that those who bought/manufactured during Freedom Week are protected by the injunction enjoining the penal code for that week.

You can’t continue to buy now.

There is an interesting issue. The state justifies making felons of persons importing, buying, and receiving large capacity magazines in order to make the public safe from being shot with firearms holding what is considered to be too great a number of rounds, but here we have someone that doesn't have a firearm that even accepts the magazine. How them does barring him from it promote the public safety? Would this be an example of the failure of the state to narrowly taylor the prohibition so as to burden the exercise of the man's 2A rights as little as possible?

Doesn't make sense to get rid of something so cheap that's not obtainable anymore to save a few bucks. The money is already spent....I'd just keep it.
