I don't want to derail this thread, it is too important.

The first time he did so my attorney had retired, but his office continued to be my attorney of record. I'm in San Diego and this attorney's assistant was from LA. I went with another attorney that worked on my case but started her own practice. She said what they did wasn't illegal but the family law environment in LA was prone to more testy behavior that San Diego. They did it again later on even though I had a non-retired lawyer handling my case.

This is what it looks like to me as well. It appears they could care less about his ruling. They just want their status quo of putting unchalleged laws into place to continue. If we get a cert on Pena I may be convinced their free reign is coming to an end.

Not hearing or seeing anything from any main stream media on this ruling?

I wonder why

We seem to be focusing this on the CA AG. But truth to be told, it was voted in by the CA population. So this ruling is huge, its a smack down on majority tyranny on 2A.

We get days of media coverage when gay marriage and illegal immigration gets their ruling by the courts. Complete opposite, with deafening silence for a 2A win. No media bias, BS.

Other Ban States maybe calling Becerra et al at the moment to urge constrain. If this end up in the Right leaning US Supreme Court, this may nullify all the magazine bans in the US.

The actual silence on this is deafening.
I didn't even see the first blast of news about it on twitter until last night.

They are fully aware that there is nothing they can do and if the general public was aware it would turn into a mix of protests and mass buying.

The ban is dead though, no one is turning in jack. Nullification cuts both ways. Their corporate globohomo buttbuddies can decide they have their own policies and ideas on what "regulation" should be. We can do it too.

If it's not federal law, then enforcement ends with the borders of the state. Shops should honestly just go ahead and remove restrictions from all states and jurisdictions. If the states want to enforce, let them enforce on the buyers and sellers keep no records. Hide it all behind an Anonymous LLC or whatever.

Number one reason why conservatives lose, is because when they win, they rest on their laurels instead of keeping up the hard won momentum.

So PSA posted the announcement on their Facebook page. So did many other retailers. This youtuber is taking the use of PSA's list in the ex-parte request to mean that they are the reason CA AG is freaking out? Seems the G&G guy has to get out (on the internet) more. He's lost if he thinks this was some secret that floated around under the radar until the PSA post. It blew up the minute the judge handed down the decision.

This youtuber's about as credible as the Daily Shooter...that is to say, not very. Youtube is cool in that it gives anyone that chance to be publicly heard*, but at the same time, just becasue you have a camera and a mic, it doesn't mean you're credible.

It took Benitez ~1.5 months to respond to the initial Duncan-v-Becerra complaint in 2017, which resulted in the preliminary injunction that got the ball rolling. Just saying.

There is no urgency, as Benitez already provided data in his opinion that "LCMs" have been readily accessible by mass shooters and other criminals over the past 19 years. Granting a temporary stay does not alter that, as Benitez opined that the original law was ineffective anyway. Therefore, the state does not have a strong argument of "irreparable harm."

Just read through both responses, it's hilarious.

Michel makes a simple case:

"Plaintiffs oppose the State’s request for a temporary stay of the judgment
while the Court considers the State’s Ex Parte Application to Stay Judgment Pending
Appeal of this Court’s Order Granting Plaintiffs’ Motion for Summary Judgment.
Plaintiffs understand the State’s concerns, but should the judgment be stayed
immediately, even if only temporarily, countless otherwise law-abiding Californians
who have already ordered LCMs in reliance on the Court's order but have not
received them would unjustly be subjected to severe criminal penalties without
notice."


Basically, Becerra is acknowledging that millions of mags are on the way in, and he even suggests that people that are accepting possession of these magazines should be protected, LOL:

"Plaintiffs urge that the request be denied “unless the Court can unequivocally
protect those individuals in an order granting the State’s temporary stay request.”
(Opp’n at 2:9-10.) Nothing prevents this Court from fashioning appropriate interim
relief for persons who take possession of LCMs purchased between the issuance of
the Judgment and an order staying the effect of that Judgment
, if there are any such
individuals. And a temporary stay will limit the number of people who might find
themselves in that situation. For that reason, a temporary stay, issued immediately,
is an appropriate remedy to protect both the State and law-abiding citizens acting in
reliance on the Judgment."

I think Yes why not...in fact people can own those things with enough $ the right connections and permits... so the only reason normal people can't is because of all the red tape and $..

If that Freilich pays any attention to the media she would see that routinely during drug busts the bad guys already have that stuff (maybe not tanks, but the terminator owns at least 1)...

(Opp’n at 2:9-10.) Nothing prevents this Court from fashioning appropriate interim

individuals. And a temporary stay will limit the number of people who might find
themselves in that situation. For that reason, a temporary stay, issued immediately,
is an appropriate remedy to protect both the State and law-abiding citizens acting in
reliance on the Judgment."

Is Becerra high? No evidence people are buying up mags?

What a piece of **** liar. Just yesterday as evidence for need for a stay he cited that sales were going on.
