Post First amendment rights... Against Calgunners? WTF

As I've already explained to 69mach1 and to leelaw:

As a company or anything in general for that matter, can't take away a members first amendment... As a forum and marketplace, you understandingly allow people to post and view what is known as there right to freedom of speech.

Example: Facebook can't tell people not to cuss, but instead the can take a single letter out of that one or more word(s) and replace it with a star sign.

The First Amendment (Amendment I) to the United States Constitution is part of the Bill of Rights. The amendment prohibits the making of any law "respecting an establishment of religion", impeding the free exercise of religion, infringing on the freedom of speech, infringing on the freedom of the press, interfering with the right to peaceably assemble or prohibiting the petitioning for a governmental redress of grievances.

the first: I explained a factual base a a sellers product and get a warning!

Second time: I only said that I like it and bump... which is minimal... to say the least...

I've warned both moderators that if they continue to take members rights away they will suffer the lawsuit consequences!

69mach1's answer: You do not have a first amendment right to free speech on this private site. follow the rules, or good bye.

Leelaw's answer: Upon creation of your account, you agreed to abide by the terms of service of membership at Calguns.net. These terms include following all rules of the forums, including the Marketplace forum rules, as specified in the links which I have provided you twice now, and which are also posted at the top of each Marketplace forum for your convenience.

You will follow the rules, or your account will be limited. I look forward to you reviewing this with your attorney, who will tell you that you have no case whatsoever for a Constitutional Amendment rights violation.

I hope your attorney doesn't charge you too much for a remedial high school civics lesson.

Cheers,
Lee

Leelaw also added: Frivolous lawsuits may incur expensive (for you) countersuits. You may wish to discuss that with your attorney as well.
As to this conversation, we are done here, and so is your access.

Regards,
Lee

This is a private forum.
I own it, I set the rules, I allow access as I see fit.
(Gee, I sound like ogre when I put it that way..)

You do NOT have a first Amendment right in a private venue.
Civics 101.
Quote:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
See that part in bold?
That specifies who this Amendment is restricting, Congress, which means the Government, not private citizens.

Your 1st Amendment right to free speech is a guarantee against GOVERNMENT restriction of specific classes of speech and/or expression.

Your 1st Amendment right to free speech does NOT afford you any protection in private venues such as someone's home or business.

Think of it this way, if I come to your house and start spewing profanity in front of your child can you tell me to stop or to leave or are you bound by the 1st Amendment to just let me continue in your living room?

WHAT?!?!?!? That's a violation of his first amendment rights!

He has already warned the moderators that if they continue to take members rights away they will suffer the lawsuit consequences!

Is that the legal term for 'death by riding a Hayabusa'?

I sat with an attorney too.

We had beer, got a little tipsy, he groped one of the waitresses and we had to leave.

What do I think? I think you're so far off base it's not even funny. Well, actually it is funny. Have fun wasting money consulting your attorney.

OP,

This is a private site. The owner can go on a ban hammer spree if he chooses to do so just because he owns it without having to give any explanations. Sorry.

This is a dictatorship, an anarchy.

I think it is to the benefit of everyone else to see this thread....the OP seems to show a clear example of not understanding what the United States Constitution is all about.

There are a lot of Americans who don't seem to understand or make an effort to think about it.
