Default Selling a C&R rifle

Hello! I am sorry to bring up a topic that may be addressed somewhere else but I have read some conflicting information and due to the special circumstance of living in CA I really just need a definite answer. I recently got my c&r license and I want to sell a c&r rifle that I purchased. The buyer is not a C&R holder. How do I go about the sale? Do I need to do a ten day wait? Does it need to be through an ffl01? I want to make sure I do this right. Thanks!

Fill out the paperwork that you have, get his name, current address, DOB, etc. Just fill out your form correctly.

I'd STRONGLY urge you to do some more research online, I may be missing something.

First of all, if the C&R rifle is over 50 years old then you don't need to go through an 01 FFL for the transfer. The buyer must at least 18 years of age.

If the buyer is not a California resident then the transfer must take place at your licensed premises and the transfer must also be legal in the buyer's State. Or you can ship the rifle to a dealer FFL in the buyer's state.

You need to record the buyer's name and address and DL number in your bound book in the DISPOSITION section. If you ship it to an FFL in the buyer's State then you record the FFL's info in your bound book instead of the buyer's info.

Thanks for the replies. I am looking for my stack-o-stuff that came with my license. Unfortunately I seem to have put it with my car keys, my sunglasses, that $20 I got from the bank, etc. The buyer is in CA so it sounds like all I need to do is record the sale? I don't have to report it? Sorry if I am asking dumb questions. I just don't want to screw this up on accident

So you're out of state and want to sell/ship the rifle to a non ffl03 holder in ca?

CA Resident to CA Resident (does not matter if either hold a FFL03) can trade/sell a longgun over 50 years old face to face no FFL01 involved (Until 2014). Given that they are over 18, and not a prohibited person.

Since you have your FFL03 you will need to log this dispossession (even if you owned it prior to becoming licensed). You will need their info for your bound book. Most commonly this is done by asking them to bring a photocopy of their DL for you.

First you need a bound book. A 3-ring binder with sheets is fine if you don't want to buy one from Brownells.

Info you need from buyer: Name, date of birth, address, CA Driver's license number.

Fill out this info on the form and the rifle's info and stick it in your binder. Any new acquisitions go in the same way.

You don't report the sale, but if you ever get audited by the BATFE, they will ask to see your bound book and may record that info out of it. Audits are happening more and more to 03 holders, so make sure you have the info in there and correctly.
