What not to do if you have a CCW . . . .
Dude starts a roadrage fight, gets his azz kicked, then pulls a gun on the azz-whoopers.

He started the fight and then resorted to his gun when he was getting whooped.

although I agree with all the notes about de-escalation, it was 2 of them on only one of him. He didn't pull his gun at first it was only after he was getting beat up by 2 men. What is up with 2 guys fighting one? That isn't fair. I hope the gun owner gets a firm reprimand but really nothing else is warranted here. Would I have acted that way? No, but still.

Problem is that, as aggressor, he started the altercation with his punch (a battery) but with the defense they reacted with unreasonable and excessive force. But he might've been better off not discharging the weapon. Guy should face the music, he would probably be acquitted (but not for battery) under these circumstances, or DA might decline to prosecute. He would say that he fired it not to shoot them but to let them know that he meant business and to remove the threat. He will, though, be convicted of battery for throwing the first punch. Check up on the rules of self defense here. They are probably similar there with respect to changing of the actor as aggressor. 'Dem punks became the aggressors when they chose to use excessive, unreasonable force on the original aggressor. Both of them should also be charged with battery. Maybe I missed something, but he wasn't "armed" when he walked up to the pickup. He became "armed" after being punched to the ground by two people. What would you say if the lady, fearing for her husband, got out and shot the attackers who were clearly beating her husband?

It seems clear to me that they backed off the way they did because they saw the gun. You're correct that we can't see if it was pointed at them.... but I've seen enough fights to know these guys weren't "done"....and people in the middle of beating someone down don't start taking big steps back simultaneously for no reason. I'm confident they saw it in her hand as she was coming around the car or she was pointing it in their direction.
